The latest available government figures have shown what most people think. Motorists who use there mobile phones to text, surf the net or call while on the road, are not being punished. Home office data from 2012 shows that just 92,700 drivers were given fixed penalty notices while using the roads in England and Wales. That number of convictions is down 25% on the year before, and over 70,000 behind the highest year for convictions in 2005.
